1-on-1 Coaching


THE SCOPE OF MY SERVICES

Health coaching sessions are educational in nature. I am not a physician or psychologist, and my coaching does not include treatment or diagnosis of specific illnesses or disorders. If you suspect you may have an ailment or illness that may require medical attention, then you are encouraged to consult with a licensed physician without delay. Only a licensed physician can prescribe drugs. Any mention of drugs during consultation is only for the purpose of providing a complete history of drugs that you are taking and not for me to judge the appropriateness of the medication. Any change in prescription of dosage is a decision you make with your physician.  You should never use my knowledge or opinion to act against the advice of your doctor, and should always ask your doctor's advice before acting on any suggestions I offer you. While people generally experience greater health and wellness as a result of embracing a healthier attitude, lifestyle, and diet, I do not promise or guarantee any results, including improvements to health and wellness or protection from future illness.

WHAT IS INCLUDED IN THE MONTHLY COACHING PROGRAM


The monthly coaching program includes 1-on-1 calls, coaching support between calls, notes from our coaching calls, and other resources provided at my discretion. It also includes all of my preparation for our coaching calls, including the review of any health materials you share with me.


The monthly coaching program operates on a 4-week period, which will include 1-on-1 coaching calls of either 30 or 60 minutes on a weekly or every other week basis. The 4-week period begins on the day of your first coaching call within that period and ends 4 weeks later. The program option including coaching calls on a weekly basis will include 4 calls during that 4-week period, and the program option including coaching calls on an every other week basis will include 2 calls during that 4-week period.


Payments for each 4-week period will be made on the Monday prior to the first scheduled 1-on-1 call (if the first call is scheduled on a Monday, then the payment will be made on that day), and will recur every 4 weeks until you notify me that you would like to cancel or pause the coaching services. The price for each 4-week cycle is subject to change, but you will always be notified of any changes in pricing prior to the first affected payment. The price for the monthly coaching program does not include supplements or any other suggested tools for improving your health.


1-on-1 coaching calls can be hosted over Zoom, Telegram, or WhatsApp. The 1-on-1 coaching calls are meant to be used during the 4-week period, but sometimes unforeseen circumstances arise and we may schedule the calls beyond the 4-week period. In this case, the calls are only guaranteed within 3 months of the payment that covered the calls. If you do not use a 1-on-1 coaching call during that 3-month period, it can only be scheduled at a future time at my discretion, and will otherwise be forfeited.


Coaching support between calls is included within the 4-week period and can be carried out through any communication medium. The coaching support between coaching calls is meant to be used for simple, time-sensitive questions. There is no limit to this communication. There is no guarantee for response times to this communication, but I will try to respond to simple and time-sensitive questions within 2 business days. I may choose to reserve answers to more complex or less-time-sensitive questions for our coaching calls. I tend to respond sooner to messages left on Telegram or WhatsApp as opposed to email or any other means of communication.


CONFIDENTIALITY


I will keep your information private and no disclosure will occur without your consent unless compelled by law.


COACH EXPECTATIONS


I will try to be the best coach that I can for you. I will try my best to provide support, remain open-minded, communicate effectively, and use my health expertise to provide you education to help you become as healthy as possible.


CLIENT EXPECTATIONS


As a coaching client, I ask that you communicate a complete and accurate account of your health and medical history. I also ask that you remain open-minded and patient when making changes to improve your health.


RESCHEDULING AND CANCELLATION OF CALLS POLICY

You may reschedule your appointment(s) by sending me a message or using the scheduling software without penalty at any time up to 48 hours before the scheduled appointment time, as long as the appointment is rescheduled for a time within the 4-week payment period. A call can be typically rescheduled for a time outside of the 4-week payment period if needed, but this is subject to my discretion. If this rescheduling is approved, the 4-week period will extend to cover the rescheduled call and the following 4-week period will begin at the next scheduled call time. For example, if the 4th and final scheduled call of the weekly calls during a 4-week period is approved to be rescheduled for the following week, which would be the 5th week from the first call during that 4-week period, the 4-week period would be extended to include the 5th week and the payment for the following 4-week period would be pushed back by 1 week to accommodate this extension.


Cancelling or rescheduling of a call within 48 hours will result in the forfeiting of that call. I will typically make exceptions to this for emergencies and unforeseen circumstances, but this is subject to my discretion.


If you do not attend a scheduled call, the call will be forfeited. I will typically make exceptions to this for emergencies and unforeseen circumstances, but this is subject to my discretion.


This policy is in place out of courtesy for other clients or potential clients who are unable to schedule meetings due to a lack of availability.

CANCELLATION OF MONTHLY COACHING PROGRAM POLICY


The monthly coaching program operates on a 4-week period and will recur every 4 weeks on a continual basis until you notify me that you would like to cancel or pause the coaching services. You may cancel or pause at any time, at which point you will no longer be responsible for paying the following 4-week period.


RESTARTING THE MONTHLY COACHING PROGRAM POLICY


After cancelling or pausing the coaching services, you can resume at any time, assuming that the monthly coaching program is still being offered and I have availability. The price for the monthly coaching program is subject to change, and you will be notified of any changes in pricing prior to resuming.


REFUND POLICY

Considering that there is no long-term commitment for the monthly coaching program and you may cancel or pause at any time, there are no refunds offered under any circumstances outside of my discretion. Partial refunds are not offered if you decide you would not like to continue during a 4-week coaching period outside of my discretion.


LIMITATION OF LIABILITY


"Jay Feldman Wellness" (the "Company") provides educational health and wellness coaching services. The Company is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise or diet on a medical condition.


You understand and agree that you are fully responsible for your well-being during your participation in the services provided by the Company, including your choices and decisions. You acknowledge that all comments and ideas offered by the Company are solely for the purpose of aiding you in achieving your defined goals. You have the ability to give informed consent, and hereby give such consent to the Company to assist you in achieving such goals.


The Company shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the services; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the service; or (iv) any other matter relating to the service.

In no event shall the Company’s total liability to you for all damages, losses, and causes of action (whether in contract, tort including, but not limited to, negligence, or otherwise) exceed the amount paid by you to the Company, if any, for accessing the services.


This limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed its essential purpose.


Energy Balance Course

The Energy Balance Course and any related coaching is educational in nature. I am not a physician or psychologist, and the Energy Balance Course and my coaching does not include treatment or diagnosis of specific illnesses or disorders. WHAT IS INCLUDED IN THE ENERGY BALANCE COURSE


The Energy Balance Course includes 8 weeks of content, comprehension questions with personalized feedback, a 30-minute 1-on-1 call with me, and a free 1-month trial in the Energy Balance Solution program.


The 8 weeks of content is provided on the https://courses.jayfeldmanwellness.com domain. The course is designed to be completed in 8 weeks, but you do not need to complete the course content within an 8-week time frame. Students who enroll in the Energy Balance Course have lifetime access to this content as long as the website is still running and they do not request a refund as described below in the REFUND POLICY.


The comprehension questions are open-ended quizzes at the end of each week’s content. They do not have to be completed if the student does not want to, but it’s highly recommended that the student completes the comprehension questions to help further the comprehension and application of the course material. If the student does complete the comprehension questions, personalized feedback will be provided through the course website. The feedback will be provided as soon as possible, but there is no guarantee for the amount of time it will take to provide feedback.


The student is entitled to one 30-minute 1-on-1 coaching call with me within six months of either the completion of the course or 8 weeks after enrollment (whichever comes first). The 1-on-1 coaching call can be hosted over Zoom, Telegram, or WhatsApp.  If the student does not schedule their 1-on-1 coaching call within this 6-month period, they can only schedule their coaching call at a later time at my discretion, and the 1-on-1 coaching call will otherwise be forfeited. The times available for 1-on-1 coaching calls is limited to what is provided in the calendar link, and there is no guarantee that any time slot will remain open.


The student is entitled to a free 1-month trial in the Energy Balance Solution program within six months of either the completion of the course or 8 weeks after enrollment (whichever comes first). They can enroll in their free 1-month trial using the link provided by email. If the student does not wish to continue their membership in the Energy Balance Solution program following the 1-month free trial, they must let me know by email at [email protected] prior to the date of their first membership payment, which will be exactly one month after they enroll in the free 1-month trial. Please refer to the PAYMENTS & MANAGING OF THE MONTHLY SUBSCRIPTION section under Energy Balance Solution for more information.


CONFIDENTIALITY


I will keep your information private and no disclosure will occur without your consent unless compelled by law.

UNLOCKING THE ENERGY BALANCE COURSE


The Energy Balance Course content is released in weekly sections by default, where the student cannot access the content for later weeks until they have been enrolled for that period of time. The student may request that the rest of the course content is unlocked so they can view the rest of the content at their own pace without waiting for each week’s content to be unlocked. If the student’s request to unlock the course content is granted, they will no longer be eligible to a refund within the first 30 days of the date of enrollment or at any other time. This policy is in place to protect us from students taking advantage of the offer to unlock the course content by then consuming all of the content material and asking for a refund after.

REFUND POLICY

I am confident that the Energy Balance Course is the best program for helping you accomplish your health goals, but I understand that the program will not be the right fit for everyone.


Students are eligible for a refund for the Energy Balance Course within the first 30 days of the date of enrollment, assuming they have not unlocked the course, under which condition the student would not be eligible for a refund at any time. If a student would like a refund, they must request a refund by sending an email to [email protected] requesting a refund during this 30-day time period. If provided a refund, the student will no longer have access to the course content or comprehension questions and feedback and will no longer be entitled to a 1-on-1 coaching call or a 1-month free trial in the Energy Balance Solution. After the first 30 days after the date of enrollment, students are no longer eligible for a refund. Students on a payment plan are obligated to pay the course in full unless they request a refund within the first 30 days of the date of enrollment.

WHAT IS INCLUDED IN THE ENERGY BALANCE SOLUTION


The Energy Balance Solution is a monthly membership that includes group coaching calls, access to a video library and resources, and access to a community forum.


The Energy Balance Solution is hosted on the https://courses.jayfeldmanwellness.com domain. The video library, resources, community forum, and group coaching call sign-up can all be found at this domain. Students who enroll in the Energy Balance Solution have access to the features of the program for as long as they continue their monthly membership. Each month of membership starts on the day of the most recent payment and ends exactly one month after that payment.


Group coaching calls are hosted over Zoom. Students may attend using Zoom’s application or by calling in by phone. Students are entitled to sign up for and attend up to two group coaching calls each month of their membership. If they sign up for a call but do not attend the call, they are not entitled to sign up and attend another call in its place during that month of their membership. The student may cancel their call and schedule for another call in its place at any time up to 48 hours before the scheduled group coaching call time. If the student cancels their call within 48 hours of the scheduled group coaching call time, they are not entitled to sign up for another call in its place. This policy is in place out of courtesy for other students who are unable to attend a group coaching call due to a lack of space.

Students are entitled to sign up for and attend up to two group coaching calls each month of their membership.


If they sign up for a call but do not attend the call, they are not entitled to sign up and attend another call in its place during that month of their membership.


The student may cancel their call and schedule for another call in its place at any time up to 48 hours before the scheduled group coaching call time. If the student cancels their call within 48 hours of the scheduled group coaching call time, they are not entitled to sign up for another call in its place.


This policy is in place out of courtesy for other students who are unable to attend a group coaching call due to a lack of space.


PAYMENTS & MANAGING OF THE MONTHLY SUBSCRIPTION


The Energy Balance Solution is monthly membership program with a subscription that automatically renews each month for $119. The renewal will occur exactly one month after the date of enrollment, and will continue on the same basis exactly one month after the previous payment.


If a student enrolls with a free and or discounted trial, that rate only applies to the first month of membership. After that, the subscription will continue to renew monthly at the rate of $119.


A student can pause or cancel their subscription at any time by sending me an email at [email protected] requesting that they would like to pause or cancel their membership. Cancelling the subscription will stop any future payments unless the student restarts their subscription. Pausing the subscription will stop future payments until a specified date agreed upon when the subscription is paused. Requests to pause or cancel a subscription must be made prior to the next payment in order to prevent the payment from occurring – they cannot be made retroactively after a payment has been processed.


When their subscription is paused or cancelled, the student will no longer have access to the group coaching calls, video library and resources, and community forum. A student can restart their subscription at any time by sending me an email at [email protected] requesting to do so or by enrolling directly on the website, at which point they would regain access to the group coaching calls, video library and resources, and community forum.


REFUND POLICY

Due to the nature of the Energy Balance Solution program, there are no refunds offered. Students are responsible for managing their membership as detailed in the “PAYMENTS & MANAGING OF THE MONTHLY SUBSCRIPTION” section above.
